These Terms of Service (“Terms”) govern your use of GardenAI (the “Service”) at gardenai.io. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The service
GardenAI is an AI-based garden assistant that helps you identify plants, turn your garden details into care guidance, organize seasonal tasks, and optionally sync reminders to a calendar. We may add, change, or remove features over time.
2. Accounts & eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use GardenAI. You are responsible for keeping your account credentials secure and for activity that happens under your account.
3. Acceptable use
You agree not to misuse the Service — including attempting to disrupt it, access it in an unauthorized way, reverse-engineer it, or use it to store or transmit unlawful content. You retain ownership of the content you add (gardens, plants, photos, notes); you grant us the limited right to process it in order to provide the Service.
4. Care guidance is not professional advice
GardenAI provides AI-assisted plant identification and garden-care guidance. Care suggestions are editable guidance, not a guaranteed diagnosis, and they may be incomplete or wrong. Do not rely on GardenAI for decisions about plant toxicity, edibility, or safety for people or animals — verify with a qualified professional. You use the guidance at your own discretion and risk.
5. Third-party services
The Service may integrate with optional third-party services, such as calendar sync. Your use of those integrations is also subject to the third party’s own terms and privacy policies. How we handle your data is described in our Privacy Policy.
6. Disclaimers & limitation of liability
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, GardenAI will not be liable for any indirect, incidental, or consequential damages, or for any loss of plants, data, or profits, arising from your use of the Service.
7. Termination
You may stop using the Service and delete your account at any time by contacting hello@gardenai.io. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm GardenAI or its users.
8. Changes to these terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Continued use of the Service after a change means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Except where applicable law requires otherwise, any dispute arising from or relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.
